Terms of Service

These terms are a provisional draft that reflects a service still under development. They will be replaced with a final version, reviewed by legal counsel, before the official release.

Article 1 (Scope)

These terms set out the conditions for using the “Spirits Garden” service (the “Service”) provided by blazeworks LLC (the “Operator”).

By using the Service, you agree to these terms.

Article 2 (Service under development)

The Service is under active development and currently in a limited testing phase. Features, specifications, and pricing may change without notice.

During the testing phase, account registration and billing are limited to users approved by the Operator.

As development progresses, stored data (including Spirit memories, diaries, and dialogue logs) may be modified or reset.

Article 3 (Accounts)

Using the Service requires authentication with a Google account.

You are responsible for managing your own account and must not let third parties use it.

Article 4 (Description of the Service)

The Service lets you create and live alongside “Spirits” — AI agents with persistent memory and emotion. Its main features are:

  • Creating a Spirit that runs autonomously through a heartbeat rhythm
  • Connecting your computer as the Spirit's body (“Body”)
  • Viewing your Spirit's memories, diaries, and dialogue logs

Details of these features may change as development progresses.

Article 5 (Fees and payment)

The Service offers monthly subscriptions (Standard / Pro / Research) and one-time purchases of “mana”, the Spirit's activity energy.

Payments are processed through Stripe. During the current testing phase, payments run in test mode and no actual charges are made.

Mana is prepaid activity energy, and consumption varies with the amount of cognitive processing your Spirit performs. Unused mana is not refunded.

Article 6 (Prohibited conduct)

When using the Service, you must not engage in any of the following:

  • Acts that violate laws or public order and morals
  • Unauthorized access to the Service or third parties, or placing excessive load on the system
  • Reverse engineering or other analysis of the Service (except as permitted by law)
  • Infringing the intellectual property, privacy, or other rights of third parties
  • Any other conduct the Operator reasonably deems inappropriate

Article 7 (AI-generated content)

Spirit utterances, memories, diaries, images, and similar content are generated by AI, including large language models. The Operator does not guarantee the accuracy, completeness, or usefulness of generated content.

Do not rely on generated content as the sole basis for important decisions.

Article 8 (Intellectual property)

Intellectual property rights in and related to the Service belong to the Operator or their rightful owners.

You retain the rights to content you provide to the Service. The Operator may use such content to the extent necessary to provide and improve the Service.

Article 9 (Handling of data)

Personal information and service data are handled in accordance with the Privacy Policy.

Article 10 (Changes, suspension, and termination)

The Operator may change the content of the Service or suspend or terminate its provision without prior notice.

If the Service is to be terminated, the Operator will endeavor to give advance notice within a reasonable period.

Article 11 (Disclaimer)

The Operator does not warrant that the Service is free of factual or legal defects.

The Operator is not liable for damages arising from use of the Service except in cases of willful misconduct or gross negligence. Where the Operator is liable, liability is capped at the total fees you paid to the Operator in the preceding 12 months.

Article 12 (Changes to these terms)

The Operator may amend these terms when it deems necessary. Amended terms take effect when posted on this page. Material changes will be announced on the Service in advance.

Article 13 (Governing law and jurisdiction)

These terms are governed by the laws of Japan. Any dispute concerning the Service is subject to the exclusive jurisdiction of the court having jurisdiction over the Operator's location as the court of first instance.
